We are a construction company. We did a job where there was mold. We contacted a mold specialist to come in and test it. He told us that we could use his "air scrubbers" (equipment) so that it would pass. We never signed any rental agreements. We had verbally agreed that if we paid for the price of the filters that he wouldn’t charge us a rental fee. We finished the job and contacted him regarding taking the equipment back. He said he was going out of town and would call us when he returned. He didn’t. It is now 9 months later and we have contacted him many many times to give them back. Now he sent us a bill for the rental fee for the equipment. He has no signed rental agreement because we never signed one. We have had to store the equipment for him for 9 months. What is the best way to handle this?

Confirm this with a lawyer, but you need to send him certified mail (preferably served by a third party) stating that he needs to come and claim his abandoned property within 30 days or you will dispose of it.

State clearly that you do not owe him anything, and don’t elaborate.
